Your access and use of  the Platform, any part thereof, or anything associated therewith, including its content (“Content”),  any products or services provided through the Platform or otherwise by Nora Apothecary, and any  affiliated website, software, or application owned or operated by Nora Apothecary (collectively,  including the Platform and the Content, referred to as the “Service”) are subject to this Privacy  Policy unless specifically stated otherwise. This is our entire and exclusive Privacy Policy with  respect to the Platform and Service, and it supersedes any earlier version.

Information About You That We May Collect 

Basic Access Information 

While you may be able to use some of the functionality of our Website without registering a  member account, some services or subscriptions on our Website may require registration. If you  use our Website without registering or only visit the login page without registering, the only  information we collect will be Basic Access Information (information that is typically not traceable  back to an individual and cannot be used to identify an individual). Such Basic Access Information  includes, but is not limited to, the device used to access the Website and Platform, IP address,  browser agent, and geographic location. The Basic Access Information may be collected through  the use of cookies or similar technologies.

Personally Identifiable Information 

We collect Personally Identifiable Information (information that can be traced back to you, such  as your name, billing address, phone number, email address, and zip code) when you register a  member account on the Website and/or Platform. Personally Identifiable Information may also be  collected through any statements or content that you voluntarily submit or otherwise post on the  Website and/or Platform, including, but not limited to, comments, videos, photographs, and other  images. It is recommended that you remove any embedded location data in any Personally  Identifiable Information that you voluntarily submit or post publicly to the Website and/or  Platform.

Our need and basis for collecting and processing this information is to ensure access  to additional Services. You may also choose to not provide this information, in which case, your  experience on our Website and/or Platform may be diminished.

I, the participant, wish to participate in events and other opportunities organized by Nora Apothecary (“Nora Apothecary”).  I understand and acknowledge that events and other opportunities organized by Nora Apothecary are intended to provide general information, education, and/or coaching on a range of health and wellness related topics, including, but not limited to, mental  health and mindset, sleep improvement techniques, stress reduction, immune system health, nutrition and weight loss  methods, as well as information on supplements and vitamins and other general health and wellness related topics 

(collectively, all such events and opportunities, including all information, education, or coaching topics which may be  provided, is the “Content”). Any participant seeking individualized medical advice should consult with their personal health  care provider. 

By accessing, participating in, or otherwise interacting with the Content, participant acknowledges and agrees to the following  disclaimers, release, and waiver of liability (“Agreement”): 

1) Assumption of Risk and Informed Consent. I hereby release, discharge, and covenant not to sue (and relinquish my rights to sue) 360 Health, its  managers, members, agents (including managing agent), employees, independent contractors, attorneys, and their  respective successors and/or assigns as well as third parties who contribute to the Content (each a “Released Party”)  from and with respect to any and all liability, claims, demands, actions, suits, rights and/or causes of action of  whatever kind or nature, now or hereafter existing, whether known or unknown, present or future, foreseen or  unforeseen, whether caused by the negligence of Nora Apothecary or a Released Party or otherwise, that may arise from  my interaction with or participation in the Content, including, without limitation, the risks of trying new foods or  supplements, the risks inherent in making lifestyle changes, and any damage to property, bodily and/or personal  injury, loss, death, or illness. I hereby waive any protections which may be afforded by any statute or law in any  jurisdiction whose purpose, substance, and/or effect is to provide that a general release shall not extend to claims,  material or otherwise, which the person giving the release does not know or suspect to exist at the time of executing  the release. 

4) Indemnification. I agree to indemnify, defend, and hold harmless Nora Apothecary and the Released Parties from and  against any loss, damage, claim, suit, liability, demand, cost and/or expense, paid or incurred by Nora Apothecary or any Released Party, or asserted against any of them (including attorney’s fees, court costs, and disbursements) caused  in whole or in part, by, or arising directly or indirectly out of my accessing, participating in, or otherwise interacting  with the Content, my participation in any and all programs or events offered through Nora Apothecary, and/or my breach  of this Agreement, including my own negligence, willful misconduct, or intentional act or omission.  

5) Miscellaneous. This Agreement shall also bind my assigns, heirs, executors, administrators, guardians, and next of kin  and is governed by, construed, and enforced in accordance with the laws of the State of Indiana in the United States  of America without giving effect to conflict of law principles. If any portion of this Agreement is held invalid, I agree  that the intent of the parties is that this Agreement be as broad and inclusive as permitted by Indiana law and  applicable federal law, and that the remainder of the Agreement shall remain in full legal force and effect. This  Agreement constitutes the entire agreement of the parties and supersedes all prior agreements, understandings,  negotiations, statements, promises, and discussions, oral and written, between the parties hereto with respect to the  subject matter of this Agreement. The provisions of this Agreement will continue in full force and effect with respect  to all programs, events, and other Content offered through Nora Apothecary

6) Execution. I have had an opportunity to consult private counsel regarding this Agreement prior to its execution. I have  read and fully understand the terms of this Agreement, that I may have given up substantial rights by signing it, and  sign it freely and voluntarily. I agree to abide by and be bound by the terms and conditions of this Agreement. This  Agreement has been executed by me or my legal representative with authority to execute such documents on my  behalf and may not be used by any other person for the purpose of participating in or otherwise interacting with the  Content. The Content is intended only for adults who are at least eighteen (18) years of age, and I warrant and  represent that I am at least eighteen (18) years of age as of the date set forth below.
